Yes, any fence, swimming pool enclosure, hydro-massage pool, or outdoor swimming pool that was in existence prior to the by-law's enforcement date and was lawfully erected is deemed to be in compliance with the by-law. However, it must be the same size, height, length, width, and comprised of the same materials, and may be maintained as erected, including any repair work that may be required from time to time.
You may not use any hazardous material, chicken wire, barbed wire, other barbed or sharp material or projection, or an electrified fence that contains a device for projecting or transmitting an electric current. Yes, the height restrictions for fences are different for non-residential properties. The town of Lasalle was very smart with this, when it comes to double gates that form a pool enclosure the secondary leaf must remain in a fixed and locked postion when not in use. This means that while the master leaf [primary gate] is required to have a spring loaded hinges - the secondary/slave gate does not have to have this extra hardware.
The town will try to keep your deposit... Kind of sneaky in our opinion. While we are quick and efficient, landscaping and pool projects can run into delays. I have not heard of this being enforced, however that is the bylaw.

The wire must not be less than 12Ga in dia. with the diamond openings not being wider than 2 inches. This is unusual compared to most towns in Essex County which require fence companys to not exceed a diamond size of 1.5 inches if they want to use it within a pool fence.
